1. Scope of these terms

These Terms of Use govern your use of the FynTwin platform (the ‘Service’), provided by FynTwin d.o.o. , Rudeška cesta 238, 10000 Zagreb, Croatia (‘we’, ‘us’, ‘Provider’). By accessing or using FynTwin, you accept the terms in this document.

If you do not agree to these terms, do not access the Service.

2. Definitions

• Service: The FynTwin platform for automated financial data analysis, including balance sheets, income statements, cash flow, financial forensics and AI commentary.
• User: An individual or company using the Service, including auditors, accountants and finance directors.
• Data: Financial documents, general ledger entries, CSV files and other data you upload to FynTwin.
• Output: Analysis results: reports, risk scores, audit checklists and detected financial anomalies.

3. Description of the Service

FynTwin is a software-as-a-service (SaaS) platform providing automated tools for:

• Preparing balance sheets, income statements and cash flow reports from general ledger entries
• Horizontal and vertical analysis of financial indicators
• AI commentary referencing Croatian Financial Reporting Standards (HSFI)
• Financial anomaly detection, including Benford analysis, duplicates and outliers
• Going concern evaluation with reference to ISA 570
• Audit checklists with more than 40 items

The Service is available as a web application, accessible from a device with an internet connection and a web browser.

4. Registration and accounts

4.1 Registration

You must register an account to use the Service. Provide accurate and complete details, including your name, email and company. You are responsible for keeping your password secure and must not share it.

4.2 Authentication

You are responsible for all activity on your account. Notify us immediately if you suspect unauthorised access or misuse.

4.3 Right to refuse service

We reserve the right to refuse registration or suspend an account without notice if we suspect misuse or a breach of these terms.

5. User obligations

As a user, you must:

• Data accuracy: Ensure that uploaded Data is accurate, complete and validated. You are solely responsible for its accuracy.
• Legal compliance: Use the Service only in accordance with applicable law, including the GDPR and applicable Croatian and international legislation.
• Prohibited conduct: Hacking, viruses, spam, misuse of the Service and unauthorised commercial redistribution are prohibited.
• Confidentiality: Do not share access to a demo or trial account with third parties without permission.

6. Intellectual property

FynTwin elements, including code, algorithms, design, brands and content, are protected by copyright. You may not copy, modify or distribute them without express permission.

Outputs generated from your Data, including reports and analyses, are your proprietary materials and may be used for your own purposes. However, you may not:

• Repackage Outputs as your own Service
• Distribute or commercially use other users’ Outputs
• Publish Outputs without our permission, except with your client documentation

7. Limitations and liability

7.1 Disclaimer of warranties

IMPORTANT: FynTwin is an automated analysis tool and does not replace the professional judgement of an auditor, accountant or financial adviser. The Service is provided ‘as is’, without warranties.

7.2 User responsibility

You are fully responsible for:

• The accuracy and validity of uploaded data
• Interpreting Outputs and making decisions based on them
• Applying information from AI commentary and audit checklists
• Understanding relevant financial standards, including HSFI, IFRS and ISA

7.3 Limitation of our liability

Except where the law requires otherwise, FynTwin is not liable for:

• Errors or inaccuracies in Outputs caused by Data or algorithms
• Financial loss, incorrect decisions or legal consequences of decisions based on Outputs
• Failure to satisfy auditing standards or a lack of professional judgement
• Incorrect use of the Service or failure to follow instructions
• Indirect, incidental or consequential losses

7.4 Service availability

We aim for 99% availability but do not guarantee uninterrupted service. Maintenance, updates and critical errors may cause interruptions.

8. Payment and subscription

8.1 Prices

Pricing is provided on request and specified in your individual offer. Applicable renewal prices and changes are communicated as agreed in that offer.

8.2 Payment

By agreeing to a subscription, you accept the charges. Subscriptions renew automatically unless cancelled.

8.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Payments already made are not refunded.

9. Changes to the terms and Service

We may change or discontinue parts of the Service without notice. Changes to these Terms will be published on this website. Continued use of FynTwin constitutes acceptance of the revised terms.

10. Data protection

Information on processing your Data, safeguards, locations and rights is provided in our Privacy Notice. Applicable contractual data-processing terms are agreed separately.

You may request deletion or export of your Data at any time.

11. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Croatia . Disputes will be resolved before the competent courts in Zagreb , unless the law permits otherwise.

We will first try to resolve a dispute through negotiation. If negotiation fails, the dispute will be resolved under Croatian civil procedure.
